Charles: I have to say they should have left this law alone! The average person that files bankruptcy is desperate and it is a last resort. the way the law used to be is that any debt you racked up ninety days prior to your filing was not allowed, in other words you couldn't take out a fifty thousand dollar personal loan and then file for chapter 7 and give the bank the finger. this is a loss for the little guy. though massachusetts is only 15% republican which clearly is a blue state big teddy let the little guy down.
This law is clearly WRONG!! How did it ever pass the Senate with a 3-1 margin (74-25)? One thing is for sure Mrs. Clinton having not voted no one can ever call her Stupid!!!

Too many people confuse luxuries with necessities and feel that if their friends have something (TVs, cars, stereos, computers, boats, Tivo) they should have it too. But then I believe in what we called in Chicago the easy Bohemian payment plan: 100% down. It's not a bad idea. Save up for what you want. Here's another: Three-quarters of the so-called medically bankrupt had health insurance. It just wasn't enough to cover the dramatic rise in health-care costs.
I'm afraid TVs, cars, stereos, computers, boats, and Tivo never entered the picture.
Not to change the Subject, but, Everytime some new law or change in policy comes out of the Blue, I wonder is the problem as important as what the smoke it creates is hiding. Example, War in Iraq, smoke screen Social security, smoke screen bankruptcy. I just bought a flashlight that shines through smoke but it doesn't help.
Remember the adage one bad apple can spoil the barrel, apply it to smoke.
I had to file once and I am still ashamed of it. I had to pay for knee surgeries as a result of a genetic issue. I tried to work two jobs and sell Avon as well. I really wanted and still want to meet my bills. My goal is to still pay back those companies and if I cannot do that, then to pay it back for someone else. I could get into the details but it really doesn't matter. Filing bankruptcy is NOT the answer. If you can pay your bills, do so. Coming from this side of the fence, there are definitely things I should have done differently. I did not own a Tivo or a car. I just paid for surgery and then missed work unpaid because of recovery time. I had to decide and weigh out the costs both financially and health wise. I could not walk up and down stairs due to a leg length difference and was in pain daily. I feel like a failure still because my heart is such that I would give anything to pay stuff back.
Take responsiblity and do everything you can so you do not have to file bankruptcy. Circumstances in life may cause you to have a financial struggle but I feel that if you are bankrupt because you want the good stuff, then you have no one to blame but yourself.

My brother told me that when her husband was president, a woman asked for an audience with Bill to discuss the cons of signing the bankruptcy bill at the time. I forgot what her role was; obviously a lobbyist against the bill. Anyway, as luck would have it, she got an audience with Hillary and later said that Hillary was her finest student; astute, intelligent, asked all the right questions and understood all the nuances of both sides of the argument. Hillary then went to Bill, explained it to him and influenced him to veto the bill.
However, now the story has taken its twist. She is senator of NY state, home of Wall Street, the banking industry etc...and they give her a lot of money.
My brother said she sat out the vote.
And, as I see it, (although math is not my strength, she knew her vote wouldn't influence the outcome either way. Am I right?) She hedged her bet.
Regardless, she'll take the hit. It WILL catch up with her; I'm sure of it.

For fourteen years I worked at a court- two years of which I worked in the Civil Department- and I can only tell you that approximately 90 percent, or better, of the lawsuits filed were for medical bills. And those were filed against the working poor who had no health insurance.
And to make matters worse, if the plaintiff prevailed, and a judgment was entered, the plaintiff was able to garnish wages, and bank accounts. A Writ of Garnishment could be issued every 30 days with attached attorney fees of $250 (each time) along with an assortment of court costs! Once a month! Those poor folks could never dig themselves out of the hole in which they found themselves. Depressing.
Just for the record: Sorry . . . my apologies, I did misrepresent. Kerry DID vote AGAINST the Bankruptcy Abuse Prevention and Consumer Protection Act. My post was not intended to be a lie as has been indicated. I got my facts wrong. I never did claim that Kennedy voted against it however.
Often it is clearly understood by many that name-calling is a clear cover-up for one's inadequacies. Perhaps some of us could remember that when posting.
